Company: My Benefit Pilot, Inc. (“My Benefit Pilot,” “we,” “us,” “our”)

1. Acceptance of These Terms

By accessing or using the My Benefit Pilot website, directory, educational resources, agent listing features, contact tools, and related services (the “My Benefit Pilot Services”), you agree to these Terms of Service (the “My Benefit Pilot Terms”). If you do not agree, do not use the My Benefit Pilot Services.

2. Relationship to Agent Force (Affiliated Services; “Powered by Agent Force”)

My Benefit Pilot, Inc. and Agent Force, Inc. are separate legal entities under common ownership that provide distinct services that may be integrated.

My Benefit Pilot may be described as “powered by Agent Force” because certain infrastructure (including unified login and a shared profile experience) may be integrated with Agent Force technology. However, My Benefit Pilot directory and listing services are provided by My Benefit Pilot, Inc. and governed by these My Benefit Pilot Terms.

Agent Force subscription tools, selling websites, and agency features are governed by the Agent Force, Inc. Terms of Service.

3. Consumer Use (Browse‑Only) and Acceptable Use

Consumers do not create accounts on My Benefit Pilot at this time. Consumers may browse directory listings and educational resources.

Consumers agree not to:

  • Scrape, harvest, or copy directory data using automated means
  • Use the directory to spam, harass, or abuse agents
  • Attempt to interfere with site operation or security

My Benefit Pilot may block access or implement technical controls to prevent misuse.

4. Agent Users (Listings)

4.1 Individual Agents Only; Agencies Are Not Listed; National Producer Number Verification; Enforcement

My Benefit Pilot lists individual licensed agents, not agencies. Agency subscriptions and agency entities do not receive My Benefit Pilot directory listings.

To be listed on My Benefit Pilot, you must provide a valid National Producer Number that belongs to you and maintain any required active licenses. Agent Force and My Benefit Pilot may verify your National Producer Number, license status, and identity at account creation and on an ongoing basis, including through third‑party databases and by requesting documentation.

If Agent Force or My Benefit Pilot determines that your National Producer Number is inactive, invalid, not in good standing, cannot be verified, or does not belong to you, we may, at any time and in our discretion: (a) restrict, suspend, or terminate your account; (b) remove, unpublish, disable, or suspend your listing, profile, selling website, or other consumer‑facing content; and/or (c) require additional verification. We may (but are not required to) provide an opportunity to correct verification issues; however, we may take immediate action without notice where we believe there is fraud, impersonation, consumer harm, or regulatory risk.

Because My Benefit Pilot and Agent Force may share certain account infrastructure, enforcement actions related to National Producer Number verification, licensing status, impersonation, or misrepresentation may apply across both services, including suspension or termination of related accounts, websites, and listings. Termination for cause (including fraud or impersonation) may result in immediate loss of access and denial of refunds to the extent permitted by law.

4.2 Shared Profile Requirement (National Producer Number‑Based Identity)

To create or manage a My Benefit Pilot listing, you must create and maintain an Agent Force Profile through shared account infrastructure. Your listing remains a My Benefit Pilot service governed by these My Benefit Pilot Terms, and your use of the Agent Force platform infrastructure is subject to the Agent Force, Inc. Terms of Service.

Your Agent Force Profile is uniquely associated with your National Producer Number, and My Benefit Pilot may limit listings to one listing per National Producer Number. You represent and warrant that the National Producer Number you provide is accurate, current, and belongs to you, and you agree to keep your profile and licensing information up to date.

4.3 Licensing Verification and Public Display

My Benefit Pilot may verify licensing information and may enhance verification through services such as the National Insurance Producer Registry. My Benefit Pilot may display:

  • Your National Producer Number publicly
  • For California‑licensed agents, your license number publicly (Required)

You agree the information you provide is accurate and you will maintain active licenses where required.

5. Listing Tiers, Badges, and Ranking

5.1 Listing Tiers

My Benefit Pilot may offer tiers such as:

  • Free listing (regular listing)
  • My Benefit Pilot Pro (paid; “Pro” badge; currently $27 per month)
  • Elite listing benefits for eligible individual agents enrolled in an Agent Force subscription that includes Elite listing benefits (“Elite” badge)

5.2 Ranking Factors

Agents may be ranked using factors including:

  • Location proximity
  • Product category match
  • Badge tier (Elite, Pro, Free)
  • Randomization and cycling within a tier to rotate visibility

My Benefit Pilot may change ranking methods over time.

5.3 No Guarantee of Leads or Placement

My Benefit Pilot does not guarantee any number of leads, calls, clicks, conversions, placement position, ranking, or business outcomes.

6. Contact Tools (Forms, Direct Contact, and Customer Relationship Management Integrations)

My Benefit Pilot may allow consumers to contact agents through:

  • A contact form
  • Direct contact using agent‑provided phone or email

6.1 Message Delivery and Routing

By default, contact form messages may be sent to the agent’s email address. If an agent configures an integration by providing an application programming interface key or other credentials to a supported customer relationship management provider, messages may be routed to that provider.

6.2 Agent Responsibilities

Agents are responsible for:

  • Securing and managing application programming interface keys and credentials
  • Configuring routing and integrations correctly
  • Complying with privacy and marketing laws governing communications with consumers

6.3 No Responsibility for Agent‑Consumer Relationship

My Benefit Pilot is not a party to agent‑consumer communications or transactions. My Benefit Pilot does not guarantee message delivery, response times, or outcomes.

7. My Benefit Pilot Pro Subscription; Auto‑Renew; Billing; Cancellation

7.1 Merchant of Record

My Benefit Pilot, Inc. is the merchant of record for My Benefit Pilot Pro (currently $27 per month).

7.2 Auto‑Renewal

My Benefit Pilot Pro renews monthly until canceled. You authorize recurring charges.

7.3 Subscription Interaction: Agent Force Supersedes My Benefit Pilot Pro

A user will not be billed for My Benefit Pilot Pro at the same time the user is enrolled in an Agent Force subscription that supersedes My Benefit Pilot Pro benefits. If you upgrade to an Agent Force subscription that provides Elite listing benefits, billing transitions from My Benefit Pilot, Inc. to Agent Force, Inc., and your dashboard will reflect the active plan.

7.4 Downgrade After Agent Force Cancellation

If an Agent Force subscription ends, the user defaults to a My Benefit Pilot free listing, and the listing remains visible with limited features, subject to these My Benefit Pilot Terms and any enforcement actions.

7.5 Refunds

Refunds are handled case‑by‑case in My Benefit Pilot’s sole discretion unless required by law. Accounts terminated for cause (including fraud) forfeit refunds.

8. Content Responsibility; Compliance; Medicare Rules

Agents are responsible for the accuracy of listing content and compliance with applicable laws and regulations. My Benefit Pilot may conduct quality and compliance checks and may remove or suspend listings for:

  • Fraud or misrepresentation
  • Unlicensed activity
  • Misleading claims
  • Consumer complaints
  • Spam or abuse
  • Impersonation

For Medicare‑related marketing, you agree to comply with applicable marketing rules and to indemnify My Benefit Pilot as described below.

9. Suspension and Removal; Cross‑Service Enforcement

My Benefit Pilot may remove, suspend, or restrict listings or access at any time for violations of these My Benefit Pilot Terms, the Agent Force Terms, applicable law, or to protect consumers and platform integrity.

Because My Benefit Pilot and Agent Force may share account infrastructure, violations may result in enforcement across both services, including suspension or termination.

10. Intellectual Property; Listing License

My Benefit Pilot owns the My Benefit Pilot Services, except agent‑provided content. Agents retain ownership of their listing content but grant My Benefit Pilot a license to host, store, display, distribute, and otherwise use listing content as necessary to operate the directory and provide the My Benefit Pilot Services.

11. Marketing and Endorsements

My Benefit Pilot may market the directory and platform generally. My Benefit Pilot does not use real agents as endorsers or in promotional marketing materials beyond directory‑style display of their listings, unless the agent provides explicit written permission.

12. Privacy

My Benefit Pilot’s collection and use of personal information is governed by My Benefit Pilot’s applicable privacy policy, including separate consumer and agent privacy policies as applicable. See our Privacy Policy.

13. Disclaimers

To the maximum extent permitted by law:

  • The My Benefit Pilot Services are provided “as is” and “as available.”
  • My Benefit Pilot disclaims all warranties, express or implied.
  • My Benefit Pilot is not an insurance agency or insurer and does not provide insurance, financial, or legal advice.
  • My Benefit Pilot does not endorse any agent or guarantee licensing status beyond any verification My Benefit Pilot may perform.

14. Limitation of Liability

To the maximum extent permitted by law, My Benefit Pilot’s total liability arising out of or relating to the My Benefit Pilot Services will not exceed the fees you paid to My Benefit Pilot in the three (3) months preceding the event giving rise to the claim.

My Benefit Pilot will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, lost revenue, lost data, or business interruption.

15. Mutual Indemnification

15.1 Your Indemnity

You will defend, indemnify, and hold harmless My Benefit Pilot and its officers, directors, employees, and affiliates from claims arising out of:

  • Your listing content
  • Your agent‑consumer communications and transactions
  • Your violation of law or applicable Medicare marketing rules
  • Your misuse of the My Benefit Pilot Services

15.2 My Benefit Pilot Indemnity

My Benefit Pilot will defend and indemnify you from third‑party claims alleging that the My Benefit Pilot Services, when used as permitted, infringe a United States patent, copyright, or trademark, subject to standard limitations (including claims arising from your content, misuse, or modifications).

16. Dispute Resolution; Arbitration; Class Action Waiver; Wyoming Law

16.1 Governing Law

The My Benefit Pilot Terms are governed by Wyoming law, excluding conflict‑of‑law rules.

16.2 Arbitration Agreement

Except for small claims matters and requests for injunctive or equitable relief, any dispute arising out of or relating to the My Benefit Pilot Terms or the My Benefit Pilot Services will be resolved by binding arbitration in Wyoming on an individual basis.

16.3 Class Action Waiver

You waive any right to bring or participate in a class, collective, or representative action against My Benefit Pilot in court or arbitration.

17. Changes to Terms

My Benefit Pilot may update these Terms from time to time. Changes become effective when posted. Continued use constitutes acceptance.

18. Miscellaneous

These Terms constitute the entire agreement regarding the My Benefit Pilot Services and supersede prior agreements on that subject. If any provision is unenforceable, it will be modified to the minimum extent necessary, and the remainder will remain in effect.
